This Privacy Policy explains how SkylightSafetyNET, (“SkylightSafety,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with the SkylightSafety.NET software platform, including the QR-based net-tracking field web application, the customer portal at app.skylightsafety.net/portal, related mobile interfaces, and our website (collectively, the “Platform”). It applies to information we process as a business in connection with the Platform. It does not apply to information practices of third parties we do not control.

1. Two Roles: Our Information and Customer-Submitted Information

It is important to understand the two different roles we play with respect to personal information on the Platform:

  • Information we collect as a business. When a customer registers, when an Authorized User logs in, and when you interact with our website or support, we act as the business responsible for that information and process it as described in this Policy.
  • Information our customers submit about other people (e.g., workers). When a customer or its Authorized Users enter information into the Platform about individuals — such as the names, signatures, and inspection activity of crew members or competent persons — we process that information as a service provider on the customer’s behalf and in accordance with the customer’s instructions and the Terms of Service. The customer is responsible for providing any required notices to, and obtaining any required consents from, those individuals. Such individuals should direct privacy requests to the customer that collected their information.

2. Information We Collect

Information you provide directly:

  • Account and registration information, such as name, business name, email address, phone number, job title, and login credentials.
  • Communications you send us, such as support requests and feedback.

Information generated through use of the Platform:

  • Inspection and activity records, including QR-code scans, digital checklist responses, installation/removal/event logs, photographs, signatures, serial numbers, and free-text notes you enter.
  • Project and site information, such as job-site names, addresses, and net inventory and status.
  • Timestamps and, where you enable it on your device, location data associated with scans or entries.

Information collected automatically:

  • Device and usage data, such as IP address, browser and device type, operating system, pages or screens viewed, and dates and times of access, collected through cookies and similar technologies and server logs.

3. How We Use Information

We use personal information to:

  • provide, operate, maintain, secure, and improve the Platform;
  • create and manage accounts and authenticate users;
  • store and display the records and reports you generate;
  • respond to your requests and provide support;
  • send administrative messages, security alerts, and service-related communications;
  • monitor and analyze usage, detect and prevent fraud, abuse, and security incidents, and enforce our Terms;
  • comply with legal obligations and respond to lawful requests; and
  • create aggregated or de-identified data, which we may use for any lawful business purpose.

4. How We Disclose Information

We do not sell personal information, and we do not “share” personal information for cross context behavioral advertising, as those terms are defined under California law. We may disclose personal information:

  • Service providers. To vendors that perform services for us — such as cloud hosting, data storage, analytics, and software development — who are permitted to use the information only to provide services to us.
  • To the customer. Within a customer’s account, information is accessible to that customer and its Authorized Users according to the access controls the customer manages.
  • Legal and safety. When we believe disclosure is necessary to comply with law or legal process, to enforce our Terms, or to protect the rights, property, or safety of any person.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to customary confidentiality protections.
  • With your direction or consent. As you otherwise direct or authorize.

5. Data Retention

We retain personal information for as long as needed to provide the Platform, maintain your account, and fulfill the purposes described in this Policy, and thereafter as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. Following termination of an account, we handle Customer Data as described in the Terms of Service. You are responsible for independently retaining your own records, including any records you are legally required to keep.

6. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your credentials and for managing your Authorized Users’ access.

7. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, provides you with the rights described below, subject to certain exceptions. (Where we process information as a service provider on a customer’s behalf, please direct requests to that customer.)

  • Right to know / access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of recipients.
  • Right to delete personal information we have collected from you, subject to exceptions.
  • Right to correct inaccurate personal information.
  • Right to opt out of sale or sharing. We do not sell or share personal information as those terms are defined under California law, so no opt-out is necessary; if this changes, we will update this Policy and provide a mechanism to opt out.
  • Right to limit use of sensitive personal information. We do not use or disclose sensitive personal information for purposes that would trigger this right.
  • Right to non-discrimination for exercising your privacy rights.

To exercise these rights, contact us using the information in Section 11. We will verify your request, typically by confirming information associated with your account. You may use an authorized agent to submit a request on your behalf, subject to verification.

8. Children’s Privacy

The Platform is a business tool intended for use by adults in an occupational setting. It is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us personal information, please contact us and we will take appropriate steps to delete it.

9. Where Information Is Processed

We are based in the United States and process information in the United States. If you access the Platform from outside the United States, you understand that your information may be processed in the United States, where data-protection laws may differ from those in your location.

10. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice (for example, by posting the updated Policy within the Platform or on our website and updating the “Last Updated” date). Your continued use of the Platform after the changes take effect constitutes your acceptance of the updated Policy.
